GENERAL TERMS AND CONDITIONS OF SALE

OVERVIEW
These General Terms and Conditions of Sale (hereinafter "Terms and Conditions") govern the contractual relationship between SAS Niche. Studio, registered under number 94335741800012, whose registered office is located at 58 Rue de Monceau, 75008 Paris, hereinafter referred to as "Niche.", "we", "our", "us", and any individual or legal entity making a purchase on the site www.nichestudio-paris.com (hereinafter "the Client" or "you").
Niche. uses the Shopify platform to operate its online store. Any sale made on the site is conducted directly with Niche., and not with Shopify.
By placing an order on the site, you acknowledge that you have read and accept these Terms and Conditions of Sale without reservation. They may be modified at any time; the applicable version is the one in effect on the date of the order.
ARTICLE 1 — ACCESS AND CUSTOMER ACCOUNT
The site is accessible to any adult individual with full legal capacity. Minors can only make purchases with the authorization and under the responsibility of their legal representative.
When creating an account or placing an order, you agree to provide accurate, complete, and up-to-date information (email address, delivery and billing address, payment information). You are solely responsible for the confidentiality of your login credentials and any activity carried out from your account.
Any transfer, sale, or assignment of an account to a third party is strictly prohibited.
ARTICLE 2 — PRODUCTS
Niche. offers for sale pieces in Japanese selvedge denim and other premium materials, presented as numbered limited edition collections. The photographs and descriptions on the site are reproduced with great care; however, variations in shade or rendering may appear depending on your screen display settings, without this constituting a defect.
Each piece is produced in 100 numbered copies. Availability is indicated in real time; Niche. reserves the right to withdraw a product from sale at any time, especially in case of stock depletion.
The essential characteristics of the products (composition, weight, care, serial number) are listed on each product sheet. This information is a key element of consent.
ARTICLE 3 — ORDERS
Any order placed on the site constitutes a firm purchase offer. The sale is concluded upon receipt by the Customer of an order confirmation email issued by Niche., after payment validation.
Niche. reserves the right to refuse any order in case of suspected fraud, anomaly, unresolved prior dispute, or product unavailability. The Customer will be informed as soon as possible and fully refunded if payment has been made.
The Customer is invited to carefully check the contents of their order (reference, size, quantity, delivery address) before validation. Any modification request after confirmation will be handled as far as possible, provided the order has not yet been handed over to the carrier.
In accordance with the returns policy, purchases are subject to the right of withdrawal described in Article 7.
ARTICLE 4 — PRICES AND BILLING
Prices are indicated in euros, all taxes included (applicable French VAT). Delivery fees are shown separately during order validation and summarized in the confirmation email.
Niche. does not offer sales, promotions, or clearance. The price displayed at the time of order is final. In case of a clear pricing error (typographical or technical), Niche. reserves the right to cancel the affected order and inform the Customer.
For deliveries outside the European Union, customs duties and import taxes may apply upon arrival in the destination country. These fees are the responsibility of the recipient.
You guarantee that the payment information provided is accurate and that you are duly authorized to use the specified payment method.
ARTICLE 5 — PAYMENT
Payment is due in full at the time of order. Accepted payment methods are: Credit card (Visa, Mastercard…), Apple Pay.
Transactions are secured by Shopify Payments encryption systems. Niche. does not retain any banking data.
ARTICLE 6 — SHIPPING AND DELIVERY
Orders are shipped from Paris, France within a period of 3 to 5 business days upon receipt of merchandise for preorders and/or orders following payment confirmation.
The estimated delivery times are as follows:
— Mainland France: 3 to 5 business days
— European Union: 5 to 7 business days
These deadlines are given for information only and are not contractual. Niche. cannot be held responsible for delays caused by the carrier, customs services, or any force majeure event.
The transfer of risk of loss or damage occurs at the time the package is handed over to the carrier. In case of damaged or missing package, the Customer is invited to make reservations with the carrier and contact Niche. within 48 hours of delivery.
ARTICLE 7 — RIGHT OF WITHDRAWAL
In accordance with articles L.221-18 and following of the Consumer Code, you have a period of 14 calendar days from receipt of your order to exercise your right of withdrawal, without having to justify your decision.
To exercise this right, you must notify your decision to Niche. before the deadline expires, by email at contact@nichestudio-paris.com, using the standard form below or by any other clear statement.
Products must be returned in their original condition (unworn, unwashed, with tags), in their original packaging, to the following address: NICHE. STUDIO, 23 rue de Téhéran, 75008 Paris.
Return costs are the responsibility of the Customer, except in case of defective product or shipping error attributable to Niche..
Niche. will refund the full price of the product within 14 days from receipt of the returned package, using the same payment method as used for the purchase. Initial delivery costs (excluding standard fees) are not refunded.
The right of withdrawal does not apply to personalized or clearly individualized products.

ARTICLE 8 — LEGAL GUARANTEES
Independently of the right of withdrawal, Niche. is bound by the legal guarantees provided by French law:
— Legal warranty of conformity (articles L.217-4 and following of the Consumer Code): 2 years from the delivery of the goods. In case of a conformity defect found within the first 12 months, the burden of proof lies with the seller.
— Warranty against hidden defects (articles 1641 and following of the Civil Code): the Customer may obtain the cancellation of the sale or a price reduction in case of a hidden defect making the product unfit for its intended use.
These warranties do not cover defects resulting from normal wear and tear, incorrect use, or lack of maintenance in accordance with the provided instructions.
ARTICLE 9 — INTELLECTUAL PROPERTY
All elements of the site (texts, visuals, photographs, design, logo, typography, architecture) are the exclusive property of Niche. or its licensors and are protected by French and international intellectual property law.
Any reproduction, distribution, modification, commercial exploitation, or reuse, even partial, is strictly prohibited without prior written consent from Niche..
ARTICLE 10 — PERSONAL DATA AND GDPR
Niche. collects and processes your personal data strictly for order management, customer relations, and, where applicable, sending commercial communications to which you have expressly consented.

ARTICLE 11 — RELATIONSHIP WITH SHOPIFY
Niche. operates its online store via the Shopify platform. All sales are concluded directly between Niche. and the Customer. By using the site, you acknowledge that Shopify is not responsible for any aspect of the transactions made between you and Niche., and you expressly release Shopify and its affiliates from any liability in this regard.
ARTICLE 12 — CUSTOMER REVIEWS AND SUBMITTED CONTENT
If you submit reviews, suggestions, or any other content, you grant Niche. a worldwide, non-exclusive, and free license to use them for the operation and improvement of the service. You guarantee that you hold the necessary rights to these contents and that they do not infringe on any third-party rights.
Niche. reserves the right to moderate or remove any illegal, offensive, or non-compliant content with these Terms and Conditions.
ARTICLE 13 — PROHIBITED USES
Access to the site is strictly limited to personal and lawful use. The following are prohibited in particular: any use for commercial or resale purposes, any scraping, automated data extraction, identity theft, transmission of viruses or malicious code, and any attempt to circumvent the site's security measures.
Niche. reserves the right to suspend or terminate access to its service without notice in case of violation of these terms.
ARTICLE 14 — AUTOMATED AGENTS
No software or automated service ("Agent") may access the site without explicitly identifying as such in HTTP requests, nor without complying with the applicable terms of use. Niche. reserves the right to technically block any unauthorized automated access.
ARTICLE 15 — FORCE MAJEURE
Niche. cannot be held responsible for failure to perform its obligations in the event of force majeure as defined in article 1218 of the Civil Code (natural disaster, epidemic, carrier strike, etc.). In case of prolonged force majeure beyond 30 days, each party may terminate the contract by operation of law.
ARTICLE 16 — LIMITATION OF LIABILITY
To the extent permitted by applicable law, Niche.'s liability shall not exceed the total amount of the order concerned. This limitation does not apply to damages caused intentionally or resulting from gross negligence, nor to bodily injury.
The information published on the site is for informational purposes only. Niche. strives to ensure its accuracy but does not guarantee the absence of errors or omissions.
ARTICLE 17 — SEVERABILITY
If any provision of these GTC is declared null or unenforceable, the other provisions shall remain in effect.
ARTICLE 18 — ENTIRE AGREEMENT
These GTC, as well as the Privacy Policy and the Returns Policy, constitute the entire agreement between Niche. and the Client for purchases made on the site, and replace any prior agreement.
ARTICLE 19 — MODIFICATION OF THE GTC
Niche. reserves the right to modify these GTC at any time. The applicable version is the one in effect on the date of the order. In case of substantial modification, registered Clients will be informed by e-mail.
